Customer Waiver, Release & Assumption of Risk

PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS.

I voluntarily choose to participate in activities and/or use the facilities provided by The M A Connection, including martial arts training, Brazilian Jiu-Jitsu, Muay Thai, MMA, boxing, strength and conditioning, fitness training, personal training, open training, competitions, events, and recovery facilities including sauna and ice baths.

1. Assumption of risk

I understand that martial arts, combat sports, physical training and use of fitness and recovery facilities involve inherent risks.

These risks may include physical contact, falls, takedowns, throws, joint locks, chokes, strikes, strenuous exercise, equipment use, slips and falls, heat exposure, cold-water exposure and sudden changes in body temperature.

I understand that participation may result in injury, illness, permanent disability or, in rare circumstances, death.

I knowingly and voluntarily accept the risks associated with my participation and use of The M A Connection’s facilities.

2. Health & fitness

I confirm that I am physically capable of participating in the activities I choose to undertake.

I am responsible for determining whether an activity is appropriate for me and for seeking medical advice where necessary.

I agree not to participate or use the facilities while affected by alcohol, recreational drugs, illness or any condition that may make participation unsafe.

I agree to immediately stop participating and notify staff if I experience unusual pain, dizziness, breathing difficulties, faintness or other concerning symptoms.

3. Sauna, ice bath & recovery facilities

I understand that sauna and cold-water immersion involve additional risks, including overheating, dehydration, dizziness, fainting, burns, cold shock and changes in heart rate or blood pressure.

I agree to use these facilities responsibly, follow all displayed instructions and safety rules, and leave the sauna or ice bath immediately if I feel unwell.

I understand that I should seek medical advice before using sauna or cold-water immersion if I have a medical condition, am pregnant, take medication that may affect my response to heat or cold, or have any reason to believe these activities may not be suitable for me.

4. Release & waiver

To the fullest extent permitted by law, I release and discharge The M A Connection, its owners, directors, employees, instructors, contractors, volunteers, representatives and affiliates from claims arising from the inherent risks associated with my voluntary participation in activities or use of the facilities.

Nothing in this waiver is intended to exclude, restrict or modify any right or remedy that cannot lawfully be excluded, restricted or modified under applicable Australian law.

5. Medical treatment

If I become injured or ill and am unable to provide instructions, I authorise The M A Connection to seek emergency medical assistance where reasonably considered necessary.

I understand that I am responsible for medical, ambulance or other related costs incurred on my behalf to the extent permitted by law.

6. Personal property

I understand that I am responsible for my personal belongings while attending The M A Connection and that personal property is brought onto the premises at my own risk, subject to any rights I may have under applicable law.

7. Photography & media

I understand that photographs or video may be taken during training, classes or events.

Where I have provided the necessary consent, I permit The M A Connection to use my image or likeness for legitimate promotional, educational and social-media purposes without compensation.

8. Facility rules

I agree to follow reasonable instructions from The M A Connection staff and comply with safety, hygiene and facility rules.

I understand that access to activities or facilities may be refused or withdrawn where reasonably necessary for safety or for failure to comply with these rules.

9. Acknowledgement

I confirm that I have read and understood this waiver.

I understand the nature of the activities and facilities I am choosing to use and voluntarily accept the inherent risks involved.

By accepting this waiver electronically, I confirm my agreement to these terms.
